Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:

Grace Period: The period during which the consumer may exercise their right of withdrawal.

Consumer: A natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.

Day: A calendar day.

Duration Transaction: A distance contract that involves the recurring delivery or purchase of products and/or services over a period of time.

Durable Medium: Any method that allows the consumer or entrepreneur to store information addressed personally to them in a way that permits future access and unaltered reproduction.

Right of Withdrawal: The consumer’s option to cancel the distance contract during the cooling-off period.

Entrepreneur: The natural or legal person who offers products and/or services to consumers remotely.

Distance Contract: A contract concluded within a system organized for distance selling, using one or more remote communication methods up to and including the point of agreement.

Technique for Distance Communication: A method for concluding a contract without the consumer and entrepreneur being in the same place at the same time.

Article 3 – Applicability

These terms apply to every offer and distance contract between the entrepreneur and the consumer.

Availability: These Terms will be provided before the contract is finalized. If not possible, the consumer will be informed of how to review them, and they will be sent free of charge upon request.

Electronic Contracts: For electronic transactions, these Terms will be made available in a storable format.

If specific product/service terms also apply, the most favorable provisions to the consumer will prevail in case of conflict.

If any provision becomes invalid, the rest remain enforceable. Unaddressed or unclear scenarios will be interpreted in the spirit of these Terms.
Article 4 – The Offer

Validity: Any limitation in validity or conditional offers will be clearly stated.

Non-binding: Offers are non-binding; the entrepreneur can revise them.

Accuracy: Offers will accurately describe products/services. Images are representative but may vary slightly in color.

Article 5 – The Agreement

Formation: The agreement takes effect once the consumer accepts the offer and meets the listed conditions.

Electronic Confirmation: For electronic acceptance, confirmation is sent immediately.

Security: Proper security measures are implemented for electronic transactions.

Verification: The entrepreneur may assess the consumer's ability to fulfill payment obligations.

Article 6 – Right of Withdrawal

Cooling-off Period: Consumers may cancel the purchase within 14 days of receiving the product.

Condition: Products must be returned in original condition with all accessories and packaging.

Notification: Consumers must notify the entrepreneur in writing/email within 14 days.

Return Proof: Consumers must provide return proof (e.g., shipping receipt).
If no notification or return is made within the deadline, the purchase stands.
Article 7 – Costs in Case of Withdrawal

Return shipping is at the consumer's expense.

Any paid amount will be refunded within 14 days, provided return proof or actual return is confirmed.

Article 9 – The Price

Fixed Pricing: Prices remain stable during the offer period unless VAT rates change.

Market-linked: Some prices may vary due to financial market changes.

Price Increases:

Allowed within 3 months only if legally mandated

After 3 months, allowed if stipulated and the consumer can cancel

Note: Deliveries occur outside the EU. Import VAT or clearance charges may apply.

Disclaimer: The entrepreneur is not liable for typographical errors. Incorrect prices do not obligate fulfillment.
Article 10 – Compliance and Warranty

The entrepreneur ensures compliance with product specifications, reliability, usability, and legal standards.

Guarantees do not override legal consumer rights.

Claims: Must be submitted within 14 days of delivery, with products returned in new condition and original packaging.

Article 11 – Delivery and Execution

Orders are handled with the utmost care.

Delivery Address: Based on consumer-provided details.

Delivery Time: Within 30 days unless otherwise agreed. Delays will be communicated.

Refunds: Issued within 14 days if order is canceled due to delays.

Replacements: Clearly labeled and eligible for return.

Risk: Transfers to the consumer upon delivery.
Article 12 – Duration Transactions: Termination and Renewal
Termination

Indefinite Contracts: Can be canceled anytime with a notice period of one month.

Fixed-Term Contracts: Cancelable at the end of the term with one month’s notice.

Termination must be as easy as entering the agreement.
Renewal

Fixed-term contracts are not auto-renewed unless:

Newspaper/magazine subscriptions (max 3 months) with cancelation rights.

Regular deliveries (monthly or less frequently): cancelable anytime.

Long-Term Contracts

Consumers may cancel after 1 year with one month’s notice unless fairness dictates otherwise.
Article 13 – Payment

Unless agreed otherwise, payments must be made within 7 business days of the cooling-off period start.

For services: Period begins upon agreement confirmation.
-
Consumers must promptly report payment data inaccuracies.
-
Late Payments: Reasonable fees may apply if disclosed in advance.
Article 14 – Complaints Procedure

Complaints must be submitted within 7 days of issue detection.

Responses will be given within 14 days.

If more time is needed, the consumer will be notified.

Unresolved complaints may proceed to dispute resolution.

Complaints do not suspend obligations, unless the entrepreneur agrees.

If justified, the entrepreneur will repair or replace items at no cost.
Article 15 – Disputes

US law governs all agreements between the consumer and the entrepreneur, regardless of the consumer’s location.
